1. Acceptance of Terms

Welcome to Novakids.ai ("Novakids AI", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, services, mobile applications ("App"), and parent dashboards (collectively, the "Services").

By registering for an account, accessing, or using our Services, you (referred to as "you", "user", or "Parent") agree to be bound by these Terms and our Privacy Policy. If you are registering on behalf of a child under the age of 18, you represent and warrant that you are the child's parent or legal guardian and agree to supervise their usage of the Services.

If you do not agree to these Terms, do not register, access, or use the Services.

2. Eligibility & Child Safety

Our Services are designed to provide educational content (including shorts, voice tutoring, homework assistance, and quizzes) to children from Pre-KG to Class 7.

Because our primary audience includes children under the age of 13, a parent or legal guardian must create and manage the primary account. Child profiles can only be created under the authorization, supervision, and active management of a parent or guardian.

We comply with all relevant child protection legislation, including COPPA (Children's Online Privacy Protection Act). We do not collect personal information from children without verified parental consent.

3. User Accounts & Security

To use most features of the Services, you must register for an account using a valid email address and credentials. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security and confidentiality of your credentials.
• Promptly update your registration details to keep them accurate.
• Notify us immediately of any unauthorized access or security breach of your account.

You are fully responsible for all activities that occur under your account, including those performed by children using child profiles associated with your account.

4. Description of Services

Novakids.ai is an upcoming AI-powered learning universe designed to make screen time educational and engaging. The features provided include:

• Educational Shorts: Short, engaging videos that explain foundational concepts.
• AI Homework Helper: Conversational support to guide students through problems without giving away answers directly.
• Voice Tutoring & Labs: Dynamic voice-driven interactive sessions for vocabulary and science learning.
• Parent Dashboard: Interface providing insights, usage reports, and preference configurations for parents.

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without notice or liability to you.

5. Acceptable Use & Conduct

You and your child agree to use the Services only for lawful, educational purposes. You agree not to:

• Use the Services to post or transmit harmful, offensive, threatening, or inappropriate content.
• Attempt to reverse-engineer, decompile, or extract the source code or underlying AI models of the Services.
• Bypass or attempt to bypass security measures, authentication systems, or rate-limiting restrictions.
• Use automated systems, scripts, bots, or scrapers to extract data from the Services.
• Interfere with or disrupt the operation of the servers, networks, or databases connected to the Services.

6. Intellectual Property

All materials, content, layouts, trademarks, logos, brand elements (including the names "Nova Kids" and "Novakids.ai"), design systems, software, audio, illustrations, and AI-generated outputs available through the Services are the sole property of Novakids.ai or our licensors and are protected by copyright, trademark, and other laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial, educational use only, subject to these Terms.

7. Account Termination

We reserve the right to suspend, disable, or terminate your account and access to the Services at our sole discretion, without prior notice, for reasons including:

• Violation of these Terms.
• Actions that could compromise the safety or security of our users or children.
• Long periods of account inactivity.
• Compliance with a legal request or order.

You may close your account at any time by contacting our support team or deleting your account via the parent dashboard. Upon termination, all licenses granted under these Terms will cease immediately.

8. Disclaimers & Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST PERMISSIBLE UNDER APPLICABLE LAW, NOVAKIDS.AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ACCURATE, COMPLETE, OR FREE OF ERRORS OR VIRUSES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NOVAKIDS.AI, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms and, where required by law, by sending an email notification or displaying a notice in the parent dashboard.

Your continued use of the Services after the publication of revised Terms indicates your acceptance of the changes.
